CJI SA Bobde headed a bench which heard the PIL. The petitioner highlights the vulnerable condition of Transgenders, the violence and humiliation they face because of the stigma prevalent in the society against them. They also highlight the level of discrimination they face in their day to day life despite several laws like the Trans Act which is set up on the guidelines of landmark NALSA Judgement. The Trans Act itself have some contradictions which are discussion of controversy like the District Magistrate will identify whether an individual belongs to Trans community or not.
In light of these reasons, the plea seeks the establishment of a welfare board for the trans community which will look after these social issues faced by Trans Community and the formation of a Standing Committee comprised of Human Rights, Station House Officer and Social Activists which will look after the police brutalities against Trans Community.
SC issued a notice seeking the establishment of the committee mentioned above and asked the petitioner to bring forth necessary details related to the legislation which may govern the establishment of the welfare board.
